Minnesota Pregnant Workers and New Parents
The poster outlines workplace rights and protections for pregnant workers and new parents in Minnesota. Under the law, employees have rights regarding accommodations and leave.
Minnesota Paid Leave provides paid time off and job protections for most employees. Qualified individuals are entitled to the following benefits:
- Employees may take up to 12 weeks for their own medical care and up to 12 weeks for bonding. If an individual utilizes both types of leave, the total is capped at 20 weeks.
- While on leave, employees may receive a portion of their normal pay directly from the state.
- Leave is available for pregnancy-related health needs, childbirth, recovery, and bonding time for both birthing and non-birthing parents.
- Bonding leave applies to birth, adoption, and foster care placements. All bonding leave must be completed within 12 months of the qualifying event.
- For those who do not qualify for Paid Leave or federal Family and Medical Leave Act (FMLA), Minnesota law still grants 12 weeks of job-protected, unpaid parental leave.
Posting Requirement
While employers are encouraged to display the Pregnant Workers and New Parents poster, it is not a mandatory posting requirement. However, employers must provide the “Nursing Mothers, Lactating Employees, and Pregnancy Accommodations” notice to new hires at the time of employment. Additionally, this notice must be given to any employee who inquires about or requests accommodations. The notice is available on CPC’s Employee Handouts and Forms webpage. For further information regarding Minnesota compliance or posting requirements, a Compliance Advisor can be reached at 1-888-339-1257.
